Dude, the Rocker C came stock with a back seat that folded out from under the solo seat, and disappeared when not in use. Harley also offered a more robust "touring" passenger setup.

Review the thread, start paying attention, and you'll notice posts from people who have done a lot of miles with a passenger. Nope, the passenger wasn't riding on the handlebars.

The rear fender is strut less and mounted to the swingarm not the frame therefor it is not suggested to attach a seat to it. But Heartland makes a kit to mount a fender softail style to the frame and a different seat setup. It's not my style I love the stock fender once you remove the license plate brake and light. And curious as to why you think the srock Rocker C passenger seat is a POS? Ever actually used one?

The passenger seat needs to be up above the rear fender, because the fender is attached to the swingarm, and moves up and down with the rear suspension and tire. If the seat was attached to the rear fender, the passenger would basically be riding a rigid frame, with no suspension.

As skid_pimp has already mentioned, this can be converted to a frame mounted fender. Or one can buy the latest version of the Rocker platform instead, the Breakout, which already has that conversion.

It's up above the fender when in use because the fender is mounted 1/4 inch above the rear tire, and bolted to the swingarm, therfore it moves up and down With the wheel. I agree the passenger pavilion is definitely different and slightly odd looking, but that is why it is only out when in use, because then the bike is fully sexy when it is 100% stowed away under the drivers seat. Which is exactly why I love the design, it is stowed much more than it is deployed, look at damn near every bike on the road, and you will see the drivers portion has far more use on it than the passengers portion, yet the passenger portion is always sticking out there often detracting from the lines of the bike, or else it has to be removed and left at home. I simply stow mine under my seat, so I can have the clean lines of a solo bike, but it is always with me, in case I am picking someone up.

but there is a conversion kit? cause i have seen others that have the rider seat against the fender. i get it that without the passenger seat it's a solo bike. And i'm not trying to take away from the look of the bike. i love the look, and it's a really comfortable bike, i just think they could of come up with a better design for how they have the rear seat on. or maybe they should of went for the appeal of it being a solo chopper style bike or put out two versions of the C

They originally had two Rockers, a C and a plain old Rocker which was a solo only bike. Yes Heartland makes a conversion that takes the back end to looking very similar to the Breakout.
