I'm running V&H Big Radius here in NYC...no problems...never been pulled over. I've had some friends that have been ticketed, but it's usually because they were already drawing attention to themselves.
Noise ordinances will likely always be beaten in the courts (especially in industrialized areas) due to other noiseproducers that far exceed what our bikes put out.
OEM or other "approved" is a different story.... That little phrase "off highway use only" will get you everytime.
Here in Colorado they supposedly have started to crack down on noise from bikes within the city of Denver itself. I don't know of anyone personally that has been stopped. I have a cop friend who says that unless they (the cops) have the right (and calibrated) noise monitoring equipment and the people who use it trained properly, they (the cops) would not have a snowballs chance in hell of making a ticket stick if it was contested.
I live in Broomfield which is close to Boulder...if Boulder starts to crack down on noise, Broomfield will follow shortly thereafter. Hope it doesn't happen. I would think that the police would have alot more important/serious things to worry about than a load motorcycle.
