It'll fit if you do something with your ICM. The ICM is mounted directly under the rider's butt on '04-'06. In '07, the ECM was moved to the rear fender, closer to the passenger. The '08 Nightster saddle does not have the pocket in the seat pan that creates a space for the ICM. Perhaps the ICM can be lowered in it's present location, or moved to the battery box area, like this (not my bike):

Check out Sick Saddles. For another $25, you can have a new seat. The stock Nightster seats are not very comfortable at all.

Thanks Guys. I would have been out $75.00. I did check out Sicksaddles but I was trying to save some bucks. Right now I'm Christmas poor if you know what I mean. Oh and Merry Christmas to all.
