One thing, banning smoking in bars and the helmet law are NOT the same. If someone doesn't wear a helmet, they're only hurting themselves. Someone smokes in a restaurant, there are others there who choose not to smoke but now must inhale the smoke of those that do
I disagree. If I own a restaurant or bar it should be up to me if I want to allow smoking or not. You don't like smoking, don't eat here! In fact, if I want to open a 'smoking only' restaurant, so what? Should be my right. And no, I don't smoke, and yes, I'm actually glad you can't smoke in restaurants but it still doesn't change the fact that they just keep chipping away at our rights. We'll soon have none.

Nothing will help your bar business more than having a bunch of cop cars waiting around outside at closing time to cherry pick your customers.
Well if the patrons are consuming alcohol and are over the legal limit .08 BAC in most places and attempt to operate a motor vehicle they are in violation of the law. So how would that be harassment if the police sit outside 500 feet away and bust drunk drivers? Just because you like the drunk drivers doesn't mean they are allowed to drive drunk. If that club wants to go out drinking then they should have designated drivers or taxi cabs or public transportation to drive them home after they have been drinking. They are no different than anyone else.

Sorry, but if your restaurant is a public place then you are subject to all of the State laws regulating restaurants. You have no "rights" otherwise. Operating a public retail business is not a constitutional right. The states retain the right to license and regulate public retail businesses to protect the general public's interests and well being.
