Picked up a Georgia Motorcycle Edition from Lawbike.com. It does state that Georgia now requires a DOT helmet. I understand this was a popular ticket handed out during the checkpoint. One of the biggest gray areas is the height of the handlebar. In GA, it has to be 15 inches from the seat to the top of the bar. What it doesn't say is how is it measured? From the lowest or highest point of the seat to the bar?
It's called the interstate commerce clause, the state is specifically granted power over commerce conducted between states. This is why any commercial vehicle can be pulled over, not just semi trucks. If I'm using my personal vehicle to haul products for my business across state lines, technically i should be subject to this clause.
As citizens not conducting business matters and not carrying business property across state lines, it is very different and no government has any constitutional right to detain or search me without reasonable cause by singling me out over someone else specifically on the type of vehicle I'm driving.
Just picture how well this would go over if, from now on, all vehicles with large rims and "Dubs" was pulled over and subjected to random search. The NAACP would have the nuts of ever police officer involved by the end of the day...... THIS is a far better comparison than your semi truck one
