it isn't staged 1. stock housing OEM style filter element changed to the K&N stock air filter element. Funny i did this same thing to my Yamaha and hadn't exeperienced any issue...I guess the HD's fuel systems are not as flexible.
Slip ons with cat and a stock filter changed and now this thing runs like crap....SMH
I think what the OP is trying to say to you is that the K&N air filter ITSELF is a high-flow air filter, no matter what the backing plate is.
I got a 16, so it might be "worse", but it started out, IMO, very lean from the factory to pass smog regulations. It starts out on the lean side from the factory, I think that is important to note. I'm surprised that slip-ons and a high flow filter element made a noticeable difference and caused issues for you. I would put the old filter element back in and see if it clears up, then put the K&N element back in and see if it returns. Might have your answer as to if thats what caused it. I put slip-ons on a week after I bought my new bike and could tell no appreciable difference, other than sound. I did the K&N filter, head pipes and de-cat'ed a couple months later and absolutely had to have it tuned for that. It ran like crap and back popped between gears and downshifting, but never any surging that I remember. Good Luck!

They run rather lean from the factory, so I'd say more than likely you're too lean.
If you don't plan to go any further with the bike, maybe a set of XIEDS would do you well.

Yup,this works in some cases.
My 09 HD was doing the same thing due to lean factory fuel calibration and as suggested above the adjustable Nightrider Xieds i installed fixed the lean surge situation.
For my bike thats basically a stock 96" with better breathing SE airfiler I found the 50% enrichment setting best to eliminate the lean surge.
They also made the motor idle better & run smoother in general along with also making throttle response a bit crisper too.
As for heat, didnt notice/feel any real reduction in engine heat post installing the Xieds.
But that could be due to the fact i already installed had wards cooling fans along with an ultracool oil cooler with twin elec cooling fans (both reduced oil temp up to 50deg f in summer heat) prior to installing the Xieds.
Could it be possible a little water got into his gas.......

I recently switched out my slip ons to something a bit less restrictive. Cat still remains in the head pipe. And I also recently switched to a K&N Filter but the stock intake has remained. I ride 12 FLHTP Electra Glide Police, and noticed today ( hot and humid) that the bike was surging at 30-35 in 3rd gear and at highway speeds in 6th at or near 70. Revs were in the 2k range at 30-35 and 2500 at or near 70.
Could those slight mods made my bike run lean mixed with the heat ?
The tune is all good when your bike warmed up smells like your dad's 55 oldsmobile (with airplane hood ornament) warming up on a cold Minny winter morning...
To add to what Kiethhu said, the O2 sensors provide information to the computer to adjust mixture to the factory programed value. As long as the computer can make adjustments to meet that requirement the computer is happy and you maintain the same mixture even with the slight modifications. Many people don't like the factory/EPA tune but as long as you are not getting an engine light, you are still meeting factory mixture requirements. Carburetors could not make adjustments in real time and that is where all of this extra lean from improved air flow came from.
The OP said nothing about how many miles on spark plugs, air filter, and fuel filter, all of which along with fuel contamination could cause his problem. Until you get a check engine light with a lean condition code your computer is still happily meeting its programmed mixture requirements and overly lean mixture from modifications is not your problem. Presuming none of the components listed above has been run beyond its service interval, I would start with some Sea Foam, Techron or some other fuel system cleaner (mixed appropriately for the size of your gas tank) and run a couple of tanks properly mixed through it before blowing big bucks on band aids and gadgets.
