08 Street Glide, Fairing Lowers, K&N High flow air filter, K&N Monster Ovals, Mastertune TTS Tuner and Dyno tune.

38 mpg average city, 44 mpg average highway and twisties with a few stops for good measure.

Sounds pretty low to me. I have a 2003 RKC with PCIII, SE intake and Supertrapp SE slip-ons. My intown gas mileage pretty much sucks (25-30 MPG) because I like the way the pipes sound when I'm heavy on the gas. I decidede to do a test today to see what my highway MPG was with my new mods. I averaged just over 47 MPG running 65-70 MPH. I'm also using one of the canned maps for the PCIII. If I were you, I would find another tuner.
