Glad to hear you were not injured. I was rearended last week too and it was hard enough to cause damage (see my post on it). I say go to the dealer and have them check it just in case. The adjuster showed up to look at my damage today then it is off to the dealer of a close inspection. I see a common thread on these crashes- cagers in a hurry and not paying attention. The lady that hit me got a ticket for reckless driving so I wonder why your situation is different?
I would be just as pissed if he was that close on my *** even if he didn't make contact.
Glad you are ok and it wasn't worse. I am not legal or traffic cop expert, but I firmly believe that anytime you make contact with the vehicle in front of you, no matter what the circumstances, it is the trail vehicle's fault.

Is this case yes... But what happens when a car pulls out in front of another car that is traveling 60mph and without leaving the other car enough time to slow down? It is not always a clear cut case as that it is the trail vehicle's fault.
And yes I would get the bike checked out.

I think most Leo's make $hit up as they are writing up the ticket. I've been driving for 30+ years and most Leo's just got out of diapers. My accident the Leo did not ticket the 19 year old girl who made a left turn in front of me (failure to yield to the right of way) cause there was no contact. But there was my bike and head contacted the asphault. I think the Leo was working on getting some from her. Anyhow glad your ok and I suggest getting the scoot checked out. Other driver paying, make sure your ride is perfect.
I would definitely Have it thoroughly checked out by the best Harley Dealer around at his Insurance costs .. Just a bit faster and you could have been injured and the Bike totaled..

I was also rear-ended about 4 weeks ago while sitting still, with both feet down at a stop, waiting to turn right. The douche-bag who hit me was looking up the hill towards the right trying to time his merge into traffic so he wouldn't have to actually stop his car before turning right! (insert epithet here)
Douche-bag sideswiped me down the left side of my '07 RK, tore off my left side hard bag (07 RK) bent pipes and guard bars, and pitched me and the bike to the right where I managed to stumble off and start shouting at him and calling him a dumb MF. He stopped about 30 feet away and jumped out apologizing all over the place, I got in a couple more curse words at him before I calmed down. Douche-Bag then tells me he didn't see me at all, and thought he had hit the curb!
His insurance paid up and I'm really lucky I didnt have to be hauled to the hospital.
BUT....... if I may offer this advice - take your bike to the dealer and have them do an inspection. it benefits both them and you! The damage to my bike was a heck of a lot more than I would have guessed at first!! Even after I got new parts and installed them (myself), there was more out of alighnment than I would have ever guessed. just my .02, but you'd be wise to have an inspection done.

Exact same thing happened to me last year. I jumped off the bike ready to rip someone apart, until I saw a very scared young lady appologizing all over the place as she got out of the car. I calmed down and looked my bike over, no apparent damage, so exchanged info and got her insurance info with a promiss I would be in contact if any was found wrong with my bike. Nothing turned wrong with the bike but had a little whip-lash the next morning. I let the whole issue slide, since my bike was ok.

Happened to me 2 years ago on my 04 Fatboy...sittn at a red light, when "bump"....I threw down the kickstand, got off, and the bitch behind me backed up and took off....put a nice dent in the fender.....damn cagers....
I am with Koppertop I would have made sure when I was shoving the front bumper of his cage up his *** that I explained to him the importance of staying off the *** of the person in front of you.

in la, the trooper would ticket the trail vehicle for following too closely.
