Im sure the dealer can look up the part number off his computer listings. I doubt that it does come with the upgrade, that way they can sell u more stuff that should have come on it in the first place, harley accessories what a money maker

the reason the 08 and later is different, is because in 08 harley touring models went to the 50mm throttle body. the 07 and earlier was i think a 43mm??? not sure, but that was why the later models require a different backing plate. a good thought though, because if you look in your parts and accessories catalog you can get the back plate for the 2008 and newer which would include your 2010. thirty nine bucks is the cost in the catalog for the backplate for your year, far cheaper than getting an entire new system. just a thought that may save you a lot of money.
