Do all dealers require damage waiver?

I would not sign, and I would take my business elsewhere if they refused to do the work without the signature.

My friend wanted a tour pack extension installed. The dealer wanted him to sign a waiver that they were not responsiable if he over loaded the tour pack and took weight off the front wheel! He did not have them install it.

My dealership has a form that is filled out when you drop off the bike. The service writer and I go over the biek and note any scratches, etc. and then I sign it. Years ago, they chipped the paint on my Street Stalker nacelle and there was no problem getting it fixed on their dime.

If someone's property is left in the care and control of another party, a bailment is created. This means that the property must be returned to its original owner in the same general condition it was received, with an allowance for normal wear and tear.

Dropping a motorcycle isn't normal wear and tear. I can't believe a dealer would try to disclaim this responsibility.

Well, I'm no lawyer, but I did stay at a Holiday Inn Express once...

To me, it's kind of like those bumper stickers on trucks that say "Stay back 200 feet, not responsible for broken windshields."

They are responsible for negligence. You just can't put up a sign or have someone sign a form that relieves you of acting responsibly. Sure, they'll use it to try and scare you into not making them pay, but they don't have a leg to stand on.

I am in the process of fighting a MC dealer right now. Took my sons 4 wheeler to a dealer to work on it and it was stolen. They had it outside in a fence with the keys in it. The fence does not go the whole way around yard, it goes from the building to a steep bank on both sides. But not steep enough to keep a 4 wheeler from being driven out. And they say they are not responcible for it and sorry about your luck. I hope we can fight and win because my son is still making payments on a 4 wheeler he does not have.Wish me luck guys.

First, you need to get a police report for stolen vehicle in the dealer's premises and second file a claim with your insurance and have it take care of the problem with the dealer. That is, if you have insurance of course. If not, get a lawyer and go after the dealer.

Thats BS, My Dealer checks the bike before it goes into the shop and lists
any and all flaws, and has me and the tech sign the sheet,when the bike
comes out it is checked again for any new damage.
TAKE YOUR BIKE ELSEWHERE

i has a rim and pulley scratched when the dealer did a tire change.they tried to say the damange was there.my bike had 600 miles on it at the time ....so i told them i must of bought the bike that way from them.th dealer replaced the rim and pulley

no way , they may not be liable for an act of god like a fire or storm or like that but even that they should have ins. for it , I vote RUN
