My friends 07 Ultra leaked where the cases bolted together behind the rear cyl & HD fixed it. The bike had about 8,000 miles on it. Do you really think you can beat HD over this BS. You might be able to get some low life lawyer to take your case.

You're riding a bike with a cheap cast crankshaft and no Timken lefty bearing support that could scissor on you on a bad downshift...and you want to file a class action over a weepng gasket?

It probably has something to do with the relative humitity.
