Vance & Hines Throttle Pak ($80 +/- at Eastern Performance) or a decent tuner with the correct map/tune will cure the lag......
i got the throttle pak and crossed my fingers, beings it wasn't being used that much and a lot of negative feed back. but it did work like they said. and I'm happy with it.

The problem I am about describe is really annoying me. All the Harleys I've owned have all had throttle cables as opposed to this bike (09 Ultra Classic Electra Glide) and the response from the the throttle (with cables) has been instant and smooth.
This is the first bike I've owned with throttle-by- wire and it works just fine off idle, but the main problem is at very low revs, particularly in 1st or 2nd gear, when I roll the throttle on from completely closed there is about 3-4mm of roll before the throttle "engages" if that makes sense.
It's my first fly by wire throttle so I'm not sure if it's me or I have a problem, but I'd greatly appreciate anyone who has experienced the same thing and addressed the problem with tuning or an adjustment of the serrated pot in the end of the handlebar or what?

Everything you wrote I can say the same about..except I have only slipons. I plan to get an air kit and tuner from Jamie at fuel moto that will not just give me a bit of power boost but also correct that lag to snap like the other guy mentioned.
This has been described many times by TBW riders. They also say they get accustomed to it. Normal.
I'm on my third HD. First two had throttle cables. My 2010 TBW is by far the most responsive and the smoothest I have ever had. Period. Nothing to "get accustomed to".
There are thousands of TBW bikes on the road now, not just HDs. It's a proven technology and for premium bikes, it's here to stay. Like everything else, it's not perfect on the HDs yet. HD skimps wherever they can to make a dime. We all know that. Just look at their ABS system compared to a BMW. So all that said, some may have issues, but for the most part, no issues.
It also appears that many of these issues may be "self induced" with improperly adjusted aftermarket tuners.
If your bike is under warranty, take it back to the shop and talk to the service manager. Maybe an induction module change-out or some other program adjustment can be made to get it where you want it.

Your dealer will be of absolutely no help with this..... just like spaghetti sauce.....it's already in there! It's a built in lag to meet EPA requirements....... the lag you are feeling is in EVERY TBW bike that leaves a HD showroom..... those that say their bikes don't have it just don't notice it or don't ride their bikes in a way that it matters...... and that's fine...
But if you want your throttle to do what YOU ask it to, I have had V&H Throttle Pack on my '09 RKC for 8000 or so miles with absolutely no problems whatsoever.... completely cleared it up and gave me my "cable" back.

It was smooth from the day I picked it up. The RP EMS didn't help or hurt it as far as I can tell. I guess I am one of the lucky ones. Hell, it may go whacky at any moment, but for now, it continues to be smooth and responsive. No delays off idle as some have reported.
You just don't notice it, that's all..... if you roll off from idle in a very slow manner the throttle body butterfly will be allowed to keep up with your request and you will not notice any "lag", but if you twist your grip in a quicker fashion, the butterfly will lag behind and won't be allowed to reach wide open throttle until the bike gets into the 3000 RPM range.... it's really that simple...
It's really noticeable on built motors when you ask for WOT right out of the hole.....
I really appreciate all the suggestions etc because as I stated in my OP the is my first Harley with TBW so I'm getting used to it.
Love the Tourer and and fell in love with it when I hired one Sept. 2010 and rode through West US through Utah, Arizona, Nevada and California so much so that not long after I got back to OZ I started trying to hunt one down.
Suggestions so far:
Get used to it - I guess I can "ride" around it
V&H Throttlepak - I can order one from one of the many online dealers in the US and looking at the V&H site fit it easily myself. But my question there is: will it address the the very low revs roll on lag that I described in my OP. It's not lag after snapping the throttle on I am complaining about.
Get the throttle reset or zeroed - not sure who I'd take it to for that and for me to work out , of course, but definitely not my local dealer, not in a million years!
