I would talk in detail with your insurance agent. Sounds like a comp claim to me, if you have that as part of your coverage, not just liability, as for the bike. Medical is a different story, your agent should be able to direct you for this instance, and better protection perhaps down the road. Great time to review all your insurance.
Agent first, lawyer later. Save $$$ you might not have to spend.

Even though he doesn't have bicycle insurance he is still liable and your insurance company or you can go after him in court...it was HIS fault.
Bicyclists can be the worst, yet they're the first to bitch to others about the "rules of the road"!

Hey, glad you are gonna be okay, but hate this happened. Where I live, there are a lot of cyclists on the road, both on the Natchez Trace and on rural roads. We actually have out of state cycle tours come in this time of year. Anyway, I have the same concerns and have actually almost wrecked my truck on two occasions while towing my tractor on a trailer going to my deer camp. The fools ride in the middle of the lane on a very narrow twisty and up and down country road.....But I have never thought about their insurance....let us know how it turns out and hope you are back riding soon.

Over the years I've met my share of morons and idiots and I truly believe their King rides a bicycle. Ive seen morons ride on the fog line when theirs 2 or 3 feet of paved shoulder. There has been times I would have liked to hang a few of them by their spandex. Dont get me wrong, I "DO" believe in sharing the roadways but don't do it in a way that endangers yourself or others. sorry about the vent! Im glad your here to write about your mishap!

You definitely need to consult with an attorney!

This is the best advice. I hate suing but in some cases it's justified. This is one of those cases. Find a good attorney and let him handle it.

I have to admit, most cyclist that I've seen do not obey the laws of the road. How many times have you stopped at a stop light only to see a cyclist stop and then go right through it. I understand they don't want to unhook their shoes but the law isn't "if you don't want to unhook your shoes, it's ok if you bike right through it." The law is you stop until it turns green and then go. It gets even more scary when there's a group of them doing this. One just about got clipped at a light on Sunday.

Got a call from his insurance agent today, home owners insurance is taking care of it. They are going to pay the medical bills and what we spend out of pocket for bandges and pain drugs. they also are going to send me a check for the deductible I have to pay on the bike to get it fix then Dairyland will get reimburst for what they pay out. And then he said in a month or so when I have healed up a bit and ready to have this over with that we would settle on pain and suffering and lost wages. State Farm is his company.
