Homeowners/renters is a liability type insurance. It should cover you. He was ticketed to fault has been established.

Well, first of all, sorry for your pain and the damage to your ride. That really sucks. Sometimes I too think folks are out to get us. It seems that every time I go out the is a cager on a side road just waiting for me to come by so they can pull in front of me. It gets me how they will appear to be looking right at you, hesitate, and then at the last second pull out in your path. Geeze!

Default who was at fault?

Just the other day I was sitting outside having lunch and a bunch of young guys were all talking about the tens of thousands of dollars they'd gotten out of injury pain and suffering claims they'd successfully brought against car drivers. Guess what? They were all cyclists. Frankly - I've had it with people who don't abide by the rules of the road. Time to take it out of his hide.
I have been an avid road cyclist for over 25 years, I have been hit while riding legally on the road by a road raging cadger- not a good time when your $2,600.00 road bike is under a car, and you are tossed into oncoming traffic.
He paid my medical check and the repair to my bicycle. I did not go on to press any charges against him, for which he was grateful. I got hit from behind with witnesses rushing to my aid, and 100yds from a major medical center.

There are good cyclists and good operators of motorized vehicles as well as the bad. Being a Cyclist has taught me to be extremely observant because I am basically meat to kill when I cycle in traffic. Same as When I ride my RKC, meat to kill when up against all other types of vehicles and animals.

Ride safe.

Did the cyclists say who was at fault?

agree. No need to turn this into an "all cyclists are clueless" thread.....some of us are motorcyclists too.

Sure - that's all well and good and I applaud cyclists who are respectful and follow the rules of the road. In my experience they seem at times to be a minority. When you ride a bicycle, you are riding a vehicle and are NOT a pedestrian. That means you stop at red lights, ride on the correct side of the road, don't ride on sidewalks, you do not ride two or more abreast if it results in slowing other motor vehicles, you ride with proper lighting at dusk and at night, you don't weave between standing vehicles in heavy traffic in a manner that endangers you and pedestrians, etc. etc.

I grew up in England and we were, at the time, required to take tests on the "highway code" and follow the law. When I was a kid I was pulled over twice by cops for violating one rule or another,I had my fair share of accidents on a bicycle so I know what you mean. I ended up in hospital with a concussion once due to an accident while riding in London where I lived at the time. I now live in Seattle WA and there's an "element" that's aggressive and completely ignorant or worse, lawless - and insurance companies are so scared of a lawsuit they'd rather offer a settlement of several thousand dollars than risk a jury judgment.

Iam not blaming all cyclist, this guy was a good person he amdit that he was in the wrong and he also helped me pick up the bike and get it off the road. When we go out riding we have to watch out for other drivers wheather it be a cager or other motorcyclist, we also have to look out for the 4 legged creatures. I just never expected to be taken down by a bicyclist. I do have medical insurance so they will pay for my injuries, Dairyland insurance will cover the bike minus my $500 deductibale then go after the party that caused this accident. When Dairyland gets thier money than they will reimurst me my $500.

Exactly right. I live in a semi-rural area with many two-lane winding roads these guys like to ride on. They get all spiffed up in their little spandex riding suits and behave like cycle *****, and literally take-over the public roadways. They're arrogant and rude, they block motor traffic behind them, and basically seem to take pride in doing it.

It's time for legislation requiring bicyclists who use public roadways to register and license their vehicles as the rest of us have to, and also legislation requiring them to carry at least liability insurance. As it stands, they get a free ride, no pun intended, to do what they do without consequence.
