Yesterday coming home from a friend of mine came into a curve and there was a bicylest coming towards me. He was looking for a trail on my side of the road, and I guess he spotted it because he came across the yellow line into my lane and didn't see me. I was going approx. 40 miles pre hour seen him come into my lane I locked up the brakes and ended up hitting his front tire. Well I went down skided about 50 ft. and ended up with alot of road rash and a bunged up knee. Let me tell you for those that haven't expreiecned road rash. Trying to wash it is the most painful thing that I've ever experienced. Had xrays on my knee, it's just been sprained. The bike has alot of damage to it I don't know if its totaled or not yet (2007 Street glide). Its. like every thing and everybody is out to get us. Any one know what insurance he would use in this case? I have Diaryland but they dont cover medical, never knew that until today. He did get the ticket for failure to yield. It has not scared me away from riding but I think it will cause me to be just that more careful, I'm not a stuiped rider. Thank goodness my wife wasn,t with me. Just wanted to rant a little, be carefull out there bros, EVERYBODY IS OUT TO GET US!
What a crazy story! Glad you're ok. I'm curious to know about your insurance question as well. Obviously, he wasn't in a car so auto insurance wouldn't come into play here. I don't think you can buy bicycle insurance ? What about your personal medical insurance? Could that step in to cover your medical bills and then your motorcycle insurance repair the motorcycle?
I'm interested to hear what some other guys have to say who may have some experience with this.
Sorry to hear about your wreck. I am also interested in the outcome of this. I wonder if uninsured motorist would cover this?
Like you I was lucky and called to add medical to my wifes bike (which we own outright) and they said sure. It was so expensive I asked about full coverage and we had a lengthy discussion of why it wasn't included with full coverage. So now both our bikes have it. I went a year without and never knew.
WTF! He needs to pay - not your insurance. So - at the very minimum, you pay from your personal medical and have them subrogate. What do you know about the cyclist? If he has an income or any form of net worth you need to go after him for actual costs and pain and suffering.
Just the other day I was sitting outside having lunch and a bunch of young guys were all talking about the tens of thousands of dollars they'd gotten out of injury pain and suffering claims they'd successfully brought against car drivers. Guess what? They were all cyclists. Frankly - I've had it with people who don't abide by the rules of the road. Time to take it out of his hide.
By the way - he may have an umbrella policy - I know I do. Covers me for $1M for this sort of thing. And that's so I'm less likely to have my house taken away from me if I really do something stupid.
Assuming he has assets take some thing out of his "***" ets.

Damn if I don't agree completely!!!!!!!!
Bicycle riders are rude and never follow the rules like WE have to do, and lord help you if you hit one. Get a lawyer, sue his ***, or talk to your ins co and them to do so.
First, if you have medical it should cover your medical (of course), and if you have uninsured coverage (required in many states) then it should cover you as well. Your insurance company can bring a subrogation claim and attempt to collect from the bicyclist. If it comes to that you are probably better off that way than pursuing him IF he does not have coverage.
Now possible coverage for cyclist - not car (would be a very unusual policy) but an umbrella policy or believe it or not, often home owners insurance will cover these matters. I encourage you to contact an attorney in your area to investigate coverage issues. Typically this is done at no cost to you. Depending on where you are located I might be able to put you in touch with someone. Good luck.

Like already mentioned if he has an umbrella policy, otherwise homeowners, maybe, assuming he has a home. Not an insurance guy, so don't know what to tell you here. I would be talking to lawyers if I were you because this is going to get real complicated, and probably expensive fast. Sure he got a ticket, but now what? What if he has nothing and you get stuck with all the bills?
I always wondered why drivers pay all of the license fees, and fuel taxes which supposedly go for the roads, yet bicyclists get all the rights? Why don't they tax the hell out of them, and then pave some bike paths for them? Nothing makes me happier then waiting behind a bicyclists or a few on a long curvy or hilly road and you cannot safely get around them; especially when they are riding more then 1 right next to each other.
And yes, I had road rash down my left side and real bad on me elbow. Could see through to the bone. They pulled gravel, glass and get this; a fish hook out of me. That was a long week in the hospital.
My experiences with cyclists leave me with the same conclusions and opinions offered above! You have been legitimately wronged in more than one way.
This might be time to 'shop' this case to a 'chaser'.... jus' sayin'...
Suggest that you find a good injury lawyer in your area and consult with him/her. Does not matter what we suggest here on this forum, what does matter is what your attorney can do for you. The other guy was cited thus assumed responsible by law enforcement for this incident. Short answer is that he must compensate you for our losses. But he is not going to do it voluntarily. Your attorney will take care of this for you while you sip beer and browse for your next bike!!
