Default 2008 FLHT Recall

Looking for opinions ..... I purchased a 2008 FLHT new from the dealer in Sept of 08. HD had a recall out on the fuel system that stated " the bike will not be delivered to the customer untill the recall was complete". Well the bike was delivered without the recall being done. I found all this out on the evening of 4 July 2012 when the engine quit with out warning in heavy traffic. I pushed the bike into a hotel parking lot 4 the night. Had the bike towed to the selling dealer the next day at a cost of $148.00. The dealer did the recall and the bike fired right up. I requested to be reimbursed for towing from the dealer, got no response, just a paper shuffle. I sent a letter to the MOCO with receipts and a case was opened. The MOCOs answer was that the dealer operates independent of the MOCO and I would not be reimbursed for towing. Harleys customer service is useless ............ I was considering buying a 2012 Ultra Limited ...... I am now looking at other brand touring bikes including Kawasaki, Victory, Triumph, and BMW. The MOCO has probably just lost another customer and they do not care.

I thought it was law if a new unsold bike (or car) at a dealer has a recall, it must be fixed and vin# logged. You can put your vin on hd website to view open recalls ( I do that as soon as I know the vin). My dealer, when a recall comes out, goes to the showroom and puts a red sticker on the headlights so sales staff down to the kid that cleans it knows not to let the bike out the door w/out fix. The 2008 recall was out before Sept. 08.

Does your state have a Lemon law ? Contact the Attorney Generals Office and the State Dept of Consumer Affairs a call from ether one of these offices will get you a quick refund .
AT&T over charged me and would not refund ,one ph call to the SDCA .
Two ours later i got a phone call ,an opoplgy and they over-nighted a check to me.

Don't forget to file a case/complaint with the NHTSA. For the dealer was in violation of federal law if the bike was a personal safety issue when he released it. But seeing as no injury happened, the dealer will probably skate, more importantly you were not hurt as a result of the part failure. And that is where the case will be judged. And HD knows that many people threaten, but fail to follow through because of cost.

Have attorney send a letter to dealer you may do nothing but break even but make them pay for the mistake. Did you talk to dealer principal or just service?

I spoke to the salesman that sold me the bike and also spoke to the service manager. They both agreed that I should be reimbursed but took no action to make it happen.

Bet some tender talking about a smear campaign to the owner of the shop will get you either reimbursed or at least a gift card.
