The only time this has ever happened to me was a couple weeks ago when I changed all the oils. I tried to start the bike and nothing. I'm thinking WTF. Thirty seconds or so later I realized I didn't have the bike in nuetral. Chalk it up to a momentary case of brain fade.
The first thing I'd do before submitting to a real problem is be certain that you're not experiencing a momentary case of brain fade (it can happen to all of us occasionally) when the alledged problem occurs. Make sure it's in nuetral and/or the clutch is pulled in.

I always, (99%) of the time, start the bike in neutral WITH the clutch pulled in. The bike will start in gear with the clutch pulled in as well. This was a total case of BIKE FADE. Not my fault. LOL.
My 2009 Ultra has done this from day one. About everything you can change has been changed. I finaly solved the problem. I just traded my 09 for a 2013 FLTRU. Expensive fix, but I'm happy.
