Kill 2 birds and go to a 103 or cams or something. It is the moco's option to rebuild or replace... You could fight for a replacement, but, may get nowhere and be out your bike for that much longer. The shop should have its better wrench doing the rebuild... Lot of guys have had a H-D dealer put in a 103 kit, etc... I am sure the one doing the rebuild will know what he is doing.

I would demand a new engine and if that fails and it shouldn't, then at minimum, a full factory extended warranty at no charge.

Just get that bad boy rebuilt with a 103 kit for your trouble and a loaner bike. that sounds fair to me. You figure if it has a problem down the line you will be able to get a little more out of them.
