If your bought it through Ebay/PAYPAL..., they have a buyer protection program. If the fellow didnt list the defects, you could have recourse. Go back to the site and print out the auction listing, and see if his purchase qualified for the Protection Program, which is free... ebay Motors is pretty strict about not listing known defects.....and you MAY have 30 days with which to file for a refund and return the bike.
FYI, the 2008 CVO Dyna's have a problem with leaking too...... Our Dealer has a beautiful Low Rider in that deep coppery brown color still sitting on his floor. Has dropped the price a few times....but no takers because of the known problem without a current fix.
The first thing to do is actually talk to the guy and see if he'll make it good. I would also talk to an experienced mechanic and find out if replacing the case is really necessary, might be a aftermarket fix? Check your rights and small claims court might get you a judgment, but will he pay it? If not, thats when you should probably visit him.

Yea, but who wants to go in and plunk down that kind of money on a bike with known problems...... plus, if you do the after market kit, that would immediately void the warranty.
I hate to say it but yes it pretty much falls under "buyer beware", especially if he didn't offer any verbal or written warranty, and I doubt he did - because it's obvious he knew what was going on. All you can really do is talk with the guy, tell him you feel duped and ask if he will help make it right. If he laughs at you or claims he did all he could by sending you a gasket, there is not much you can do legally. A good *** whoopin might make you feel better but it ain't gonna fix the bike.
The only other possibility, as has already been mentioned, is if you actually sealed the deal with a winning bid on ebay, you might have some recourse through their buyer protections.
I recently bought my daughter a new, used car. I made sure I ran a VIN check on every one we looked at, drove every one we thought was okay, and finally ended up with one that was clean from fender to fender to vin check and had a complete service history all the way down to the receipt and warranty for the tint on the windows. I was once the sucker that took people at their word. But the older I get, the more I've realized life doesn't work that way, unfortunately.
Caveat Emptor. You can contact the seller but I doubt he will assist by paying $1,000 towards the cost of new cases. There is no way he didn't know about the oil being thrown out.
