New one hands down! The 2008 is a used bike with used components that you can pick up cheaper then new prices on ebay or here on the forum. Thats apples to apples. You do not know how its was ridden, but when you can get a new one you know it was broken in properly...

I'd go with the 2010 for 3 reasons:
- new bike/new warranty
- I like the rear fender
- I like the black rims

But that's me. Trust your gut & go with what you like.

I'd go with the new '10 for the reasons already mentioned and if you buy it before Dec 31st I believe you can claim all of the sales tax that you pay on it as a credit on your federal tax return. Use the tax money you'll get back to do your mods next spring. Good luck on whatever you decide though, great bike, you can't go wrong.

Just gonna jump on the bandwagon and say go for the 2010. It will probably cost you around $1500 for a stage 1 (that's where the '08 is at) but you can decide which pipes/AC you like.

there is no way that a used 08, even with some work done, should be the same price as the 2010.

Right on fellas, thanks. 2010 sounds like a plan and that also lets me wait a bit, I got the Nightster on the trade in deal and I have until the end of March.

To answer the question on the trade up, yeah, I really love the Nightster but I am in the process of working on my first bobber over the winter and I feel like the Dyna will be a good longer distance bike. Bobber will be styled like the Nightster but hardtailed so I could use a little differentiation.

Thanks to everyone who replied, keep opinions comin' if you got em.

It depends on what you want. Sounds like the 08 was well maintained, but most certainly the warranty is gone or almost gone. I have an 08 and so far nothing has broke on it. I would be asking for more of a discount on the 08 if I bought it. They should not expect to recover the full cost of their mods. I would not pay more than 12K or so depending on the miles for the bike you describe. If you put on just pipes, you will still need a tuner, they make some nice ones that tune themselves and required no PC or dyno to tune them.
