Default need some thoughts

a while back thirtysome days ago i took the bike to the dealership: my bike was downshifting on its own during some hard braking.... they repaired it and well after about three short rides the problem returned, so i took it back explaining that the problem continued, mind you only once since the repair, they test rode it and didnt find any issues, ok fine i rode off.. later that night during a hard brake it happened again. city driving suks.. anyway i want to take it back to them but i think im gonna get the run around from them should i seek out a second opinion, or allow them to try and duplicate the problem.my issue with returning the bike to them is with my esp i feel they wont be able to bill them for this same issue again therefore they'll just tell me again they cant duplicate the problem what should i do. any of you had a similar situation

This is just a shot in the dark, but check the adjustment of the clutch cable. If it is too tight, maybe it is almost engaged all the time and just tips into lower gear when you go to slow down.
