Since it does not happen with the cap removed then the tank is definitly being pressurized, just a question of the source. If the cap is not vented (which I think is correct) and the vapor is building faster than it can be bled off (thereby forcing fuel out) they it stands to reason that if that vent line is the only way to bleed off excess vapor that it may well be restricted in some way. I would start at the tank (removing the console) and follow the line from one end to the other - I bet that it is pinched somewhere.
My bike is a brand new 2012 Dyna Switchback, it's been dripping gas since the day I drove it home on November 23rd 2011. It's got 1000 miles on it now and needs the first service. I don't want to pay for the first service on a defective bike that I might be returning so my brand new bike sits.
The vent line has been checked and declared free of any blockage and just to be sure I disconnected the vent line at the tank and ran a short piece of clear aquarium hose right out of the tank port and zip tied it to the front fork. After a short ride to warm up the motor, same results, gas dripped out of the aquarium hose. It's crazy because a few of my friends have Dyna's and none of their's drip gas and the tank design seems the same.
take it back and tell them you want it fixed, and if they cant fix it, give you a new one. if that does not work, talk to a lawyer, have good records of all the times you have had it in the shop for the same problem, dates and times of telephone conversations, and you will win.
the fact is that this substantially hurts the resale, usability and safety of your vehicle, and under the massey furgesson act as well as your state lemon law (as long as your state covers motorcycles) Harley must fix or replace it.

I did file a complaint with the National Highway Traffic Institute about this problem and was told that if enough complaints are made they will force Harley Davidson to recall the model.
I've been keeping a time line and paper trail of every contact I've had with the dealership or factory.
What's really sad is when you call the factory customer service line they won't let you speak with a factory tech just a customer service person. The customer service lady said the factory tech's equate the dripping gas to condensation coming out of a tail pipe? Since when does condensation look like gas, smell like gas, feel like gas and stain your garage floor?
I wouldn't stand for it. I have a switchback and have zero dripping fuel issues. These guys are totally stroking you with their lame *** response. I'm sure you have a version of consumers affairs there, start the paperwork and let em know you aren't going away. Put their feet to fire, a recall isn't going to happen. This is the first I've heard of anyone with this problem and I'm acquainted with approximately 20 other FLD owners.
They might just be taking the lead of some of the infamous insurance companies that deny, deny, deny in the hope you go away. Once they see you won't, then you get something done in most cases.
