Sorry about your mishap but asking this to be covered under warranty makes me sick.

You started the bike in gear, and didn't have the front brake applied when you pushed the start button.
I've ridden a long time and these bikes almost always lurch forward when cold.
Man up, replace the parts you broke and have a laugh about it a couple days from now.

Let me clarify, the clutch will not disengage. So im manning up and taking a strong stance on it.

Dude that blows. I almost told you to just deal with it because I misread your post but if you pulled in the clutch and the bike jumped out you are only guilty of not being able to hold up your bike and yea maybe they should fix it. On the other hand if you attempted to start the bike in gear without holding the clutch you should probably stick to 4 wheel vehicles.

These bikes always lurch forward when cold? I guess I better go out to the garage and adjust my clutch so that it doesn't work when the bike is cold. Never heard of that in all the bikes I've owned.

OP, I know what you meant when you said that the clutch would not disengage even with the lever pulled in. Sounds like it could be one of those clutch recall issues that the MoCo sent notices about. One piece of advice though and that is to religously find neutral before hitting the start button.

Clutch was pulled in . I've been riding a long time. Rarely would I start my previous bikes in neutral. Let me clarify that I cant even stop it without it dying. So its an obvious malfunction. ....of the bike.... not me....get it now?

I was getting ready to say mine won't even turn over with the bike in gear and the clutch not pulled in. I too always start mine in neutral. Only way I know this is that one time it was in gear when I thought was in neutral. Sounds like a defect. Hope you get it sorted out.

I read the recall was for hydraulic clutches only.

I guess I learned a bad habbit. I always leave my bike in gear when parked. I akways have it in gear in parking lots so when I back out I can move quickly. Also when in neutral, clutch pulled in, shift into 1st and the bike jumps and dies.....

When I leave my bikes over night and start up in gear with clutch pulled in, then yes it always lurches forward. Not much, but noticeable. The rest of the day no problem. The other 99% of the time it's in neutral before starting.

If it is because of the clutch recall then I take it back about the warranty. Any new bike leaving the dealership should have this fixed before letting a customer take a bike home. Hell I'll even go one further and say if they did let you ride this bike home knowing the recall had not been fixed, I'd be talking to a lawyer since the MOCO had issued a do not ride notice.

Yes IMO you have learned a bad habit starting the bike in gear. Nothing wrong leaving it in gear while parked, but imagine when you come out, throw a leg over it, find neutral and hit the start button. Then you put on your gloves, zip up your jacket, put on sunglasses, squeeze the OL's leg or whatever before you take off. At any rate, you've given the machine a little bit to warm up and get the lifeblood circulating.

Your clutch is definitely out of adjustment and that should have been setup correctly before the delivery.
