Default tc88 2001 oil over full

Probably a dumb question but I come from auto industry. My oil for the engine says it takes 3 qts. I did an oil change and filled it. Found it was over full when I saw oil coming out vent off cylinder heads. Drained oil with the bike not on the jiffy stand and adjusted to low mark with the bike upright...let it sit and checked it again after letting it get to 250° and wouldn't you know it full again. .question is can primary be getting into the oil system? I would think if it was leaking thru a seal there would be engine in primary cause it would to my assumption would have more pressure. Any advice or insight, even clsryfing the system would be appreciated

If it is a Softail, the tank is above the engine.

Due to the laws of gravity, oil stays in the crank case.

Adding to what Next In Line posted. The softail oil tank is above the motor crank case, so when the motor is not run for days, oil will drain from the tank to the crank case sump, not the pan. A softail must be started and run for a few minutes to pull all the oil that has drained into the sump back into the system. So, if you change oil with a cold motor, you drained the pan but not the crank case sump and some oil was left in the motor. You added three quarts so you now have 4+ quarts of oil in the system and the additional capacity has to go somewhere as you have discovered.

Change oil on a hot motor and problem solved. Many not understanding the softail lubrication system will check oil be fore a ride on a cold motor and see that the oil level is low. The add oil to full, take off on a ride and come home with oil all down the right side of the bike; happens all the time.
