Default Swapped engine question

I reasently purchased a 07 ultra from a local Harley dealer.
Bike had 42k on odometer , and bike had a 110 motor with 3k miles since it was swapped by the dealer. After the purchase I returned to the dealer to get an extended warranty as it was recommended by many people I spoke with. The dealer informed me that because there was a "swap" that there was no warranty aviable. Believing that I purchased a used bike I assumed that this was what I have been delt with and with a fresh motor I should be ok. Well 9months and 10k miles later the oil pump explodes. Replaced the pump, lifters, pushrods, ( high pressure) and off we go. The motor gets a slight tick after 500 miles , ok long end of the short, 3 shops later, 5k in Dyno, tuner, exhaust, fuel pump, now my tic, is a Knock.....here's my QUESTION!!!
I was not informed at the time of purchase that this bike is now a " salvage,bastard, " bike because the motor was swapped?? I am also learning that if I get pulled over I could loose my bike because the motor serial number doesn't match the Vin number. I went back through my paperwork from when I purchased it and there is no paperwork matching the motor to the frame.( certificate of origin).. What are my options leaglely??

That question would be better ask of your lawyer. Now if you want an opinion, you're fuked, especially if there is anything on the paperwork stating you bought the bike as is. You wouldn't have been able to get an extended warranty even if the engine had not been swapped, you have at least a 9 year old bike, possibly 10 depending on the in service date.

I just had a crank go out on a 103 (2011 Ultra Limited) t that had an extended warranty, the customer wanted to pay the difference and go with a SE 110 crate, but wanted to retain his extended warranty. I called the warranty company and they said as long as the replacement crate engine was available when the bike was manufactured they would cover it. I had then put it in writing and fax it to me.

You got screwed, plain and simple. Probably not intentionally, but by a dealer that doesn't know the products they sell.

Guessing the bottom end is junk. This is not uncommon on these bikes. Any bike I do motor work to gets a welded crank and bearing conversion to avoid this. As to the motor swap and legal issues with that. There are no legal concerns with a motor swap unless said motor is reported stolen. The title/registration is married to the vin on the bike not the motor. A motor swap does not influence clean/salvage title. I have done multiple engine swaps on bikes and yes a new engine does come with a MSO, but a used is only a bill of sale. If you are worried I would have the engine numbers ran by a local officer.
