Why not ? If they bike is in gear and clutch in it should start. If it is a trike the brake must be applied. If it is not starting you likely have a bad switch Try this IN gear hold clutch and front brake try to start it.
Unless it is below 20 degrees I always start mine in gear. Once it is down to 20 the clutch drag can slow starting because as we know HD clutch does drag a bit.

Yes, if the bike is in gear and the clutch lever is pulled in, the starter should crank, because the clutch is disengaged.
But this is what the OP asked:

We know the engine is not supposed to start in gear with the clutch engaged, right (at least 07 and later bikes)?
The OP, (and many others) thought pulling the clutch lever in is engaging the clutch.
Pulling the clutch lever in disengages the clutch.
Releasing the clutch lever engages the clutch.
