I would never tell my customers to 'always' get a Police Report. We couldn't care less what the Cops think.
I would tell them to comply with the Law, whatever it happens to be in your State. Then I'd shut up and let them figure it out on their own.
You go volunteering information to the Police and don't be surprised when an At Fault accident shows up on your MVR. 'Loss of control'. And it's a biggie.
When you're talking to your adjuster, just simply tell the truth. If you don't know something, say you don't know. Never lie, never embellish, never invent.
Do you have a witness? Do you have people who will sign a statement that your bike was in good order up to the moment you lowered your deductible?
Did the Agent inspect your bike before he lowered the deductible? Did you get a copy of the form lowering your deductible?
Most insurance companies will just go ahead and pay the claim without worrying about it. If they fight you over it...... Worry about it at that time.
Meanwhile, just be stone cold honest. The adjuster wants this claim closed ASAP. He's got much bigger fish to fry.
And, $2k or $5k to an Insurance Company is like 2 cents or 5 cents to you and me.
But if they think they're getting played? They'll often fight all the way the Supreme Court just to prove a point. If you're straight up, polite, not aggressive, not a butthead....... Should be fine
