Default got hit!

My iron 883 got hit by a car from the back last wednesday at an intersection. Rear fender was dented and thank god i am ok. So, i sent my bike to the harley dealership the same day and they came out with $1500 estimate. I have all the insurance information from the guy who hit me but he seems to be trying to avoid to take responsibility. I never experience this kind of things so im not really sure how things work. I have his insurance information, a witness information, but no police report. Would anybody help explain to me on what i should do? I dont want to use my own insurance to cover the expenses which will make my insurance price increase next year. please help me.

dunno if each state's procedures are different....here in hawaii...we have to file a police report to proceed with a claim. the only time i don't file a report is if both parties mutually agree not to...and if i happen to be the victim, i would need reassurance that i am getting the monies.

this one time the guy asked me not to file a report because he didn't have insurance...he was dodging my calls. when i called back and left a msg saying i'll call the police....he came up with the money the next day.

did you do a accident report threw the state ?

you always more times than none NEED a police report before anyone's insurance touches a claim.

First thing you should have done is call the cops. Without them it's hard to prove it ever happened.

Stop, Did you contact the insurance of the guilty party ? or was it the individual?
Reason: some individuals think that since no police report is in place that if they stay quiet the thing will go away. THEY ARE WRONG.
Contact their insurance immediately and go to the police department in the area of the accident if possible and file a report.
Unless you live in a state with some odd rules or the guilty party has no insurance the company will investigate, send an appraiser and pay what they consider a fair claim.
Understand that if an unlicensed insurance "person" answering the phone starts talking stupid just ask to speak to the agent and explain it is their responsibility to pay a claim on behalf of their insured client.
Expect everyone to tell you to go to your insurance first but you do not have too.
People forget all the time that accidents can happen in the middle of nowhere, weird hours, situations and police presence is not practical or available at that moment.
Time is critical and you need to act fast.

Go to your local police and file a report. Insurance will want it or it never happened. It's best to do it on scene so the police can recreate the crash scene. But definately get it on file ASAP so your not left holding the bag. Glad you didn't get hurt.

I already have all of his information including copy of his insurance card, and a name card of a witness that happens to be there. the only reason i didnt make a police report was because the guy told me he was going to pay without involving his insurance. So i didnt make a police report. Is it too late to make a police report now? i called my insurance company reporting the accident and my agent told that he is going to call the driver. The only thing i dont understand is, why the people from my insurance company is the one doing inspection at the dealership?

Don't be afraid to contact your insurance company, give them the information on the other guy's policy. That's what you pay your premiums for, they should contact the other insurance company and help you get squared away.

Do get a police report on file, can't hurt to document the incident with the legal authorities.

Your insurance company may be at the dealership to make sure you get a fair deal from the other guy's insurance. They are not just there to deny your claim and jack up your rates. Now, cable and satellite TV, that's where the gougers are.

Your agent needs a statement from the other driver, so they can assess responsibility. If you were at a stop and got hit from behind, chances are you are 0% liable, that's what they will determine, then the other guy's insurance has to pay up.
