Your insurance company can handle everything and go after the other parties insurance company. Whoevers adjuster can get your dealer money quicker.

1. ALWAYS call the police.

Sometimes you feel bad for the other person or just want to be a nice guy (or gal) but in the end you will be the one losing out.

2. Make sure everyone is ok then get their Name, Address, Phone Number, and insurance information if possible. Then shut up and walk away.

3. Only talk to the police and your insurance company.

4. NEVER admit fault even if you clearly are.

This is another hard one to if your a nice guy (or gal) and were at fault. You feel bad and want to apologize. Don't do it.

The above is what most insurance companies tell you to do.

Step one: File a police report. It can only help you come time for arbitration if necessary

Step two: File a claim with HIS insurance company. You can call your insurance company and notify them as a courtesy, but the claim goes through his.

Step three: Wait and see what the insurance company says. If they proceed with the claim, you're golden. If they deny your claim, you'll have to file with your insurance company to get your bike fixed and let the 2 insurance companies fight it out. That's where your police report comes in handy.

As the "hitter", his job is to deny any fault and he'll say and do anything to keep his name clean and not have to pay anything. Not getting the police involved was mistake #1.

Like it or not, I'd turn it over to my insurance company and let them talk it over. Good Luck settling it.

Thanks guys..i am really really not sure what to do now. The only thing i can do now is to wait. This guy is avoiding all the calls my agent made. He just didnt pick up the phone. Worst case scenario, i would just pay my deductible which is $500. quite large for a student like me.

I may be mistaken but I think that as a general rule the terms and conditions on your insurance policy require you to contact your insurance company. Besides, they have people who do nothing more than subrogate claims with other insurance companies. Why would you, as an amateur, want to go toe-to-toe with the other guy's insurance company professional? Better to let your Hired Gun take care of this for you.
