It turns out that he as diabetes and he told the cop that he blacked out and does"nt remember a thing that happened. Speed limit was 50mph and I tapped brakes and geared down to 40mph before I got hit cop said he did"nt even touch the brakes. He ended up getting the worst of it with a broken wrist and 4 broken ribs. He came down and has sinceapologized but still feel pretty pissed.

Legitimate excuse or a cop-out??? You know him better than us. Some people would try to cover up a blatent f-up with something like that. Were there any other on the scene witnesses??
Personally, having diabetes does not excuse his lack of attention at all. "If" he blacked out, it was because he did not listen to his body or his BSL before leaving out, and that in itself shoudl get his azz kicked. We have too many other dimwits on the road to watch out for without having to introduce them into our collection of riding buddies just for them to take us out too. With the price of gas what it is today, I find myself riding back and forth to work almost every day on my bike, and there have been way too many times that I've almost been run over by cagers. I've seen things done by cagers that make me cringe. From looking over their shoulder into the back seat at the kids while driving on the interstate, to reading a newspaper proped on the steering wheel, america is too complacent in our driving habits, and the cops are stretched too thin to enforce the laws we have. It's a tough world out there, stay alert!
I guess how I'd feel would depend on how plausible the diabetes story is. He's your neighbor and presumably you've known him for some time, has he ever mentioned being a diabetic before? You'll have to be the decision maker on that. In any case, his insurance should pay for your bikes and any injuries (you DID make sure he filed a claim with his carrier, right?) I can tell you from experience with my family that what he described is possible and some diabetics crash (no pun intended) quicker than others. They have to constantly monitor their signs and be aware of their blood sugar level. I've seen it more than once in my house and a 2:00 a.m. call to 9-1-1 is never anything you want to have to make, so yes it it possible his story is the real deal.
As far as the continued friendship, that's a call you'll have to make yourself.
Accident due to not paying attention, health reasons, etc. It's still his fault based on the info provided, he was not responsible and as such I would not ride with or near him again.
I would be pissed, his lack of attention to the road or his health could have resulted in much worse than injury. Diabetes can be managed but you have to manage it all the time, the wrong foods, lack of food, to much or little insulin can and will cause problems. Sorry but if this was poor attention on his part or health related it does not matter, he does not belong on the road as a driver. Harsh? well you won't think so if he injures or kills someone you care about.

That's the same damn excuse Janklow used in SD when he killedfellow biker Randy Scott. If they're not taking care of themselves, they shouldn't be driving.
Was there any alcohol involved at this poker run ? I have seen folks show up before who have been drinking and probably other things as well......I guess whatever the case, he certainly did not mean to do it....but its my opinion that when you run into someone thats ahead of you.....its your fault for not watching and reacting properly to whats infront of you.....Good luck.
