2008 model problems, brakes & throttle, tracking
If they still refuse get a lawyer, there is no reason to spend that kind of money on a bike and it have any problems. I hope the people who told him to fix it himself were kidding!
I find it rediculous that you can spend that kind of money on a bike and not have dealers or the moco do everything possible to fix it.
Remember the lemon law, three times and it is a lemon.

If the dealer can't handle this, go to a different one.
My '08 Ultra worked REALLY good right out of the box, so to speak. ABS worked as advertised, and I have had several rear wheel activations on heavy stops. One of these was on a rain-slick road - I credit it with saving me a potentially really bad problem.
I have had no problem with the electronic throttle, other than it is really sensitive at low speeds. No isssues for me on decelleration.
No clue on the tracking issues.

I got called a troll several times when I said I didn't have a problem with my bike and posted about people who bitched about Harleys. There was a guy a couple of weeks ago that was an older member here and made an obvious joke and he was called a troll several times. Ain't no big deal. Usually the real trolls get agreed with for 2 pages before someone calls them out. Sounds like you need to make a pest of yourself with the dealer and anybody else you need to, including Harley. If something was wrong with my bike, I sure would. The General chat forum is a little more raucous than the model specific forums here which makes it more fun, but you also get more sh*t thrown at you. Try the model forums, you can usually get some pretty good advice over there or find people with the same problems and get some insight into what they did to solve or not solve the problem. Welcome.

Your noisy brake pad issue will probably go away after some miles, mine did on 06 Dyna.
The other issues you point out seem quite valid, and as stated by others, stop by another HD Dealer and tell them your concerns, especially with the ABS. They may fix her for ya in a few minutes (never know).
I ain't no troll, either........................ It took the dealership 2 years to do my 2 safety recalls,and they finally replaced the failed primary bearing after 18000+ miles, and a good portion of the tranny guts to boot under warranty. You can bet I did some b!tching (2 years worth)

The dealer just may not have any techs knowledgeable/experienced with ABS on the Harleys, so they are BSing ya.
