1. happy you didn't get seriously hurt.
2. When stopped you should always have an escape route planned. Bike is in gear. Watch your mirrors. If you see an approaching vehicle and feel it is not going to stop. Put your escape plan in action.

Man, I can't believe how many of you have "lived" my worst fear. Knock on wood, 43 yrs, never rear ended. I saw the post earlier, and I do the same. I stop off to the side of the car in front, so in case the azzhole keeps coming, I can hopefully shoot the gap and get out of the way. Momma and I like to ride 60 or so. As such, I am a bundle of nerves on the Interstate 'round her, cuz these boneheads wanna go 80+, towing a big azz boat or what have you with their rigs, and I am not sure they realize we are only doing 60 or 65. They come up behind WAY too fast for this ol' boy.
Here it is months later, and you are still dickin' with the ins. co. Gawd, that's enough to make the Pope cuss. Glad you came thru it ok, well, you're not ok, but glad you were able to walk and ride away. And THANX for keeping us posted. I've never had to dial 1-800- KICK THEIR ***, but this sounds like one of those times. Man, that ins. co . steams my ****, and I don't even have a dog in this fight. Have no idea concerning Tx laws, etc. Fatboy, but up here, a call to the state ins. commish and it is AMAZING how fast these cos. move. They will jerk their license tooperate in Mn for a deal like this. The other thing that is of concern to me, up here, the ins. co. will try to void his ins. because he was driving illegally, No DL, and they walk away. Ya,you can still sue the driver, but getting blood, turnip, yadda, yadda.

they've ignored you for over a month ???
have you filed an actual claim ? or just talked to them on the phone?
claims are supposed to be decided upon within 30 days

I'd call a lawyer.

The thought crossed my mind...by the time I got up, I had my helmet off and fully intended to smash it through his windshield as I was walking back toward the truck. I was in a fit of rage and wasent thinking clearly until I noticed an infant sitting in the front seat. I ended up backing off and calling the Police.

After everything was said and done...the driver was arrested for the suspended DL. They had to wait until his GF/Wife showed on scene to take custody of the baby.

His isurance said they would cover the repairs....but my god it's been since early November and I have'nt been able to get ahold of them since early January! Again...they wont answer the phone nor return phone calls.

I got to be the unhappy middle of the oreo cookie. In Feb. of 05 riding with a few friends in the
middle of no where I needed to get away from one of these " i gotta eat, talk on the cell, and pull
my head out my @$$ at the same time people in the middle of a curve, and in doing my thing, it
was either meet the oncoming pickup face to face, take out the bike nearest to me, or gas it. I
gassed it and met up with rear of my bud's Fat Boy. He saw it coming, and gassed it too, well
not quick enough and I was the hitter and not the hittee. Thankfully he never went down, and
rode his home after prying out the fender. I wasn't so lucky, and after a few basketball type
bounces down the highway, I waved by to my ride from the back of the ambulance. I made my
bud get checked then and again a month later when he complained with 'weird headaches'. He is
OK Thanks to Man Upstairs. I'm ok but I can predict the weather changes a day early with my
knee. The @$$ who started all this by trying to read my plate with his front bumper, never
stopped or just drove around us and disappeared. I'm PO'd at the fool in the cage but I get
aggravated at me when I think about it cause I didn't give myself an out I let my guard down for
a second. Workin on not lettin that happen again. Cudo's to those who have never been
banged up and I hope it never happens to any of you!

Glad you are ok man. The gear you had on could have saved you from severe injury. Getting rear ended is one of my biggest worries as many rearend collisions I see every week. I would say 90% of them asholes not paying attention.[:@]

I feel for ya man! Happened to me years ago turning into my driveway..a 17 year old in a Chevette rear ended me. Fortunately, the bike hung up on his front bumper and never hit the road. Unfortunately, i did a somersault onto the gravel drive. Looked up and my 7 month pregnant wife ran out thinking i was dead. 20 years later and she is STILL scared to ride with me.....Guess we need eyes in the back of our heads.....

Wireless Telephone Laws FAQs
Two new laws dealing with the use of wireless telephones while driving go into effect July 1, 2008. Below is a list of Frequently Asked Questions concerning these new laws.
Q: When do the new wireless telephone laws take effect?
A: The new laws take effect July 1, 2008
Q: What is the difference between the two laws?
A: The first prohibits all drivers from using a handheld wireless telephone while operating a motor vehicle. (Vehicle Code (VC) §23123). Motorists 18 and over may use a hands-free device. Drivers under the age of 18 may NOT use a wireless telephone or hands-free device while operating a motor vehicle (VC §23124).
Q: What if I need to use my telephone during an emergency, and I do not have a hands- free device?
A: The law allows a driver to use a wireless telephone to make emergency calls to a law enforcement agency, a medical provider, the fire department, or other emergency services agency.
Q: What are the fines(s) if I’m convicted?
A: The base fine for the FIRST offense is $20 and $50 for subsequent convictions. With the addition of penalty assessments, the fines can be more than triple the base fine amount.
Q: Will I receive a point on my driver license if I’m convicted for a violation of the wireless telephone law?
A: No. The violation is a reportable offense, however, DMV will not assign a violation point.
Q: Will the conviction appear on my driving record?
A: Yes, but the violation point will not be added.
Q: Will there be a grace period when motorists will only get a warning?
A: No. The law becomes effective July 1, 2008. Whether a citation is issued is always at the discretion of the officer based upon his or her determination of the most appropriate remedy for the situation.
Q: Are passengers affected by this law?
A: No. This law only applies to the person driving a motor vehicle.
Q: Do these laws apply to out-of-state drivers whose home states do not have such laws?
A: Yes
Q: Can I be pulled over by a law enforcement officer for using my handheld wireless telephone?
A: Yes. A law enforcement officer can pull you over just for this infraction.
Q: What if my phone has a push-to-talk feature, can I use that?
A: No. However, the law does provide an exception for those operating a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way radio operated by a “push-to-talk” feature.
Q: What other exceptions are there?
A: Operators of an authorized emergency vehicle during the course of employment are exempt as are those motorists operating a vehicle on private property.

DRIVERS 18 AND OVER
Drivers 18 and over will be allowed to use a hands-free device to talk on their wireless telephone while driving. The following FAQs apply to those motorists 18 and over.
Q: Does the new “hands-free” law prohibit you from dialing a wireless telephone while driving or just talking on it?
A: The new law does not prohibit dialing, but drivers are strongly urged not to dial while driving.
Q: Will it be legal to use a Blue Tooth or other earpiece?
A: Yes, however you cannot have BOTH ears covered.
Q: Does the new hands-free law allow you to use the speaker phone function of your wireless telephone while driving?
A: Yes.
Q: Does the new “hands-free” law allow drivers 18 and over to text page(?) while driving?

i spent $100 on hyperlites.com, got a set of 2- 16 led blocks with a flash moule. they flash rapidly for 5 seconds and then go steady. easily 10 times brighter than the stock light and 100 times more attention grabbing. best 100 bucks iv'e spent on the bike so far

Sorry to say it - but this is the reason those guys in the scooter mags called Biker Attorneys do well. Man, I bet they could've helped you out by now. Who knows, maybe it isn't too late for you to give one a call and chat 'em up. I guarantee they do a phone consult for you and can tell you if they can help. Ummmm...wait. You got rearended by some jackass who was talking on a cell phone. So, yeah ~ call an attorney that specializes in bikes. Just don't call on your cell phone while you're driving. That'd be dangerous.
+1, call one of those bike specialist attorneys.................ASAP
