Can't quote the statute, but you can look it up yourself if you want. They are considered a "dangerous weapon" if they have the metal clip that attaches them to the brake lever. For more information, check this link.

The only way around this is to have the "whip" fixed to the bike...meaning it does not come off without tools. Look around and you'll see them on bikes...but look closely and you'll see they're just a glorified "streamer" in Cali...

I think you're thinking of tassles and not a "Get-Back Whip". The tassles are usually attached to both the clutch and brake levers, the leather strands are not braided together, tied onto the levers with leather only, and are for looks. With Get-Back whips, there's typically only one on the bike, the leather strands are braided, is attached on either the clutch or brake lever via a metal clip and can easily be removed.

Nope...it's definitely the Whips...they are illegal here. Any time I've seen one on a bike it has a bolt or rivet going through the "claw" piece so it cannot be yanked off and swung.
