Open Container?
In Illinois, locked in a saddlebag or tourpack, I don't think anyone would give you a ticket. Any if you were not DUI.....the cop would probably have a hard time convincing anyone that you were possibly consuming the alcohol while driving your motorcycle, which is the actual intent of the law in the first place. I am a LEO but haven't had a ticket book for a few years. I carry beer in a cooler on occasion in my tourpack but of course don't have to worry about them being open.
had a bottle of scotch in my bad....i was pulled over the side of the highway (was having an issue with the windshield.) bag open, tool kit out, bottle exposed half full, State police pulled up asked in i needed assistance...saw the bottle and all he asked was..."your not hittin that now are you" and i replied hell no....thats for when i stop for the evening...no issues...no lecture.....no problem....Most states and thier leos will use discretion in that case...just dont have it accessible and dont have it on your breath....
In florida, it is ok to have a 'un-corked' (open) botte of wine in your vehicle.
People complained about going to dinner, buying a bottle of wine and only drinking a glass and having to leave the bottle.
It is illegal to have a open can or bottle of beer in a vehicle. Now.....a bottle of Gin or Vodka (name your poison)...I don't know. I would assume (hate to do that) that bott;es of booze secured in a saddle bag would fall into the 'bottle of wine' category.
Still illegal to ride impaired though.
