I hate to sound like a money hungry vulture...but here goes! I was recently in a motorcycle accident where a kid pulled out in front of me and I hit his right front fender and did the "Evil Kneivel" over his hood. He told the cop he didnt see me and he ended up with a citation for inattentive driving. I on the other hand was only doing 20 mph hopping from red light to red light with a buddy and ended up with 2 fractured cervical spine (which isnt requiring any surgey), lacerated left ear (which is requiring plastic surgery), and road rash on parts of body including a healing scar on my freakin forehead. Went to 4 physical therapy appt. and am cleared to return back to work as an ER nurse. I was off for 5 weeks and of course still have sore achy back and especially sore tight neck. I have never sued anyone but my lawyer stated I should for obvious reasons. I have no idea on how much I could be expecting for compensation. I wasnt going to sue at first, but with a beautiful summer going by and I'm bikeless, bills are piling up (like the rest of us in the country) and all I can think of is getting a new bike. Anyone of you guys ever been in a similar situation or experience and know what I might be in for? Probably wont go to court because the kid confessed to everything and I wasnt drunk or driving crazy. Just curious! My lawyer who gets 33% states he wont know till all the numbers are in. Does this kids insurance play a part in how much we can sue for? Sorry to sound money hungry, I'm not, just eager and curious! Thanks
Since he was a fault, his insurance should pay the medical bills, some pain/suffering and time missed for not working.
Has his insurance made an offer yet?
I was rear ended in a car a while back.I Had no lawyer.
The drivers insurance co. made me an offer which I countered.I was told that I could go to court or accept the counter offer which I did.
I dont know if its worth going to court and paying for a lawyer if you did not suffer too much injury.
Thug, consider you may well have residual problems with your back and neck for the rest of your life, due to soft tissue damage and arithritis. Know this from experience.
Thug, consider you may have residual problem with your neck and back, due to soft tissue damage and arthritus, for the rest of your life. All due to an inattentive moment by this kid. The kids insurance company should pay to his limits. Anything more comes from his hide with a lawsuit. I don't believe in the ruining the kids future with large suits, but you have to think of your long term potential for suffering due to this incident.
I've learned this through experience.
Sorry for the double post

Talk to your lawyer about how much he thinks you should go for, but don't take there offer. There in it for the money and want to get off as cheap as possible.
