New. I don't know of the law is Fed or State so YMMV, but legally you have 3 days to remorse on a new vehicle and get a full refund. No new fender, get a refund.
If that would have happened at our local dealer I would have taken the bike home and got to enjoy it while they got a new fender on order and replaced it under warranty when it came in. With a good dealer this question should not have to be asked.
That's what they promised my buddy when he bought his new Deuce years ago. When He hadn't heard from them he went back to ask and they acted like they didn't know what he was talking about. They did promise, but conveniently forgot the promise. After numerous fights he ended up with store credit for much less than the cost of the fender.
Get any promises in writing. The bike is sold, the profit is counted, any action on their part now will be to minimize their expense.
I would not have wanted to even bring the bike home, but that action would have been extremely hard to do! LOL You went to pick up your new toy, how hard it would be to return empty handed.
I feel your pain bro!
BTW: I seen successful scratch repairs, but HD paint is some hard stuff to work with and I would not have a lot of faith in that avenue.

There is in Indiana! I am sure of this. They rubbed it in my face on the last car purchase (Nov 2008). The reason that I remember it so well is the fact that they held my signed loan papers because of it. During those three days I had found a better rate and swapped the loan over. Carmax.
EDIT: That could have been a Carmax thing, rather than the state? Will look further into it.

This can and probably will be disussed at great length, but short and sweet, if it were my bike, the only way it's coming home with me is with a new fender...nuff said.
Nothing wrong with color sanding and buffing,i do it every day at work,however 2 much sanding and u dont have enough uv protection if i paint it and buff it its garanteed N EW bike ..well if they do a good job id take it just make sure they guarnttee the work for at least 2yrs,if it last that long its...golden
You guys would be supprissed how manynew bikes-cars-trucks show up at dealerships with damage,some minor some major,when its noticed it gets repaired on the spot with no hesitation and the potential buyer never knows
