If you hire a lawyer today, he will get 1/3 of any money you collect. If it ends up having to go to court he will probably get 1/2. Why would you want to do that unless it was necessary?????

If, when it comes to settle this you con't like what they say, you can always retain an attorney at that time so long as the statute of limitations hasn't run out (your insurance company can tell you what the statute is in your state as they vary).

Some good advise has been posted. Whaap's may be the best. Work with the other drivers insurance company and try to get them to pay what they should pay including your all of medical. Don't release them until you are sure your back is 100%.
Now for the panic horn blowing. I have often thought as I am riding along and need to blow the horn of how handy it would be to just be able to squeeze the left grip to activate the horn. I have the Kuryakyn ISO grips which have pads around the grip. I have noticed that while riding my left index finger is never really squeezing the grip.
Someone (Kuryakyn) should design a similar grip that has a small micro-switch in one of the pads on the bottom of the grip towards the front where the index finger would rest that if you squeeze hard it will make a connection that will activate a relay to sound the horn.

Anyway,make sure you follow up with a doctor for your pain/injuries.You should go to phisical therapy asap,remember your back hurts.Keep track of wages lost.
You might be able to get the deductable paid by the kids/parents insurance.Their insurance rep will try to make you an offer for your pain/suffering,medical payments.Dont accept their first offer.You also dont want too grind them too much or the case could go to court for the settlement,this is if you dont get an attorney.
No, I'm a totally disabled Vietnam Vet and the only medical coverage I have is VA.
Like your derby cover, your back is now toast. As suggested by others; get a lawer. The silver lining in this cloud is that once the lawer is finished with her insurance co. you won't have to use the VA for medical any more, you'll be able to afford real insurance!

I agree with whaap. My experience is that if the other party was at fault, and their company comes to the table like a mensch, it can be settled well. The companies don't want litigation. I'm a good driver and have been run into twice. Both times, with a police report that showed fault of the other drive, they or their insurance company paid for my car.
Move slow. Don't give away money to lawyer, but don't settle or get screwed. Call one if you need one. And get a reference, get a good one and make sure what his cut is...
