It has a step to make it easier to get into but I can't rase my foot high enough to make it. I guess I'll try and call someone to give me a ride to West Palm to the VA. My problem is how am I going to get my daughter to the school bus stop in the morning? This really SUCKS!!! Calling my ex would really make her day, I can hear her now, "See judge I told you he couldn't take care of her! You need to give me back that child support I'm paying him."
Man, this really sucks. I'm a single dad, I have a 10 year old daughter that I have full custody of. About a half hour ago her mom dropped her off. After reading these responses, I thought I'd go to the VA and have them check out my back and knees. Well the only vehicle I have now is a Dodge pickup and I can't step up into it.

Relax there my friend - any judge would take the medicla circumstances into consideration. Your ex wouldn't make any headway with that.
Hang in there, keep us posted and know several people here will be praying for a speedy recovery and protection over the areas of your life that may be challenged for a little while.

The other insurance company is probably going to ask you for a statement. That's perfectly o.k. Keep it simple and answer their questions honestly. They will probably ask you to sign a medical authorization. This again is perfectly o.k. It let's them go to your doctor and get a medical report (which they will pay for) covering your injuries, treatments, prognosis, etc. Do not talk about settlement until you and your doctor are satisfied you have recovered from your injuries. If your injury and treatments are prolonged, again check with your insurance company as to what the statue of limitations are in your state. Some are one year, some two, some even longer. If you are not in a position to settle as the statue nears, then it might be necessary to hire an attorney to file suite. That will toll the statute and you will be able to continue your treatments and expect to be compensated even though the statue has run.

The VA is about 60 miles from here so I'm trying to find someone to take me right now but it's looking like it'll be tomorrow before I'll be able to get there. The safety of a small is great for my daughter, but it sure stinks when you need to get some where for help.

Florida is not a direct action state so you cannot "sue the insurance company". You file suit against the at fault driver but you are a long ways away from needing to take that step.
Also, insurance companies are not afraid of defending lawsuits. They do it every day. The larger carriers have Staff Counsel which are attorneys who are employed by the carrier to defend lawsuits. Instead of paying a Panel Attorney $150-$200+ an hour, they pay their Staff attorneys a salary regardless of the number of hours worked.
