I say fight it. A buddy got a similar ticket in VA and went to court for it. The bike lawyer from Richmond IIRC easily got him and others off. Take a look at what the law says specifically in your state.

True story. A few weeks ago a friend and I were stopped in Santa Rosa because we had on non DOT helmets. The officer was training a rookie and just wanted to show him how to tell a non DOT helmet by the plastic chin strap fasteners (plus the lack of a sticker).After showing my friends helmet to the rookie, he gave it back, said have a nice day, and they took off, no ticket, nothing. We thought that was pretty cool. I've never worried about it too much in California anyway.
Said he stopped me cause I was "weaving in and out of traffic". Which is false. I pulled in the middle of two lanes at a red light then made a lane change and then he pulled me over. Lane splitting is legal in California anyway. And good question on fighting it. I don't know. Any advice is appreciated.

So you would have to say he had no cause to pull you over in the first place. However, I don't think you're gonna win that tussle, Bud. Your lid was non DOT.
I have to say, because I like you guys want to see your melons have a better survival rate, the little non-DOT or quasi-DOT Fisher Price helmets look just as goofy as any other helmet. Mushroom head or no.

As i mentioned before, look up the specific state law governing motorcycle helmets and go from there. IIRC VA law is not specific and somewhat open to interpretation; not familiar with the CA statute.

I disagree. That ticket should not have been issued. The CHP Memorandum states that officers shall not issue a citation for non -DOT helmets. They shall only issue for no helmet or a helmet that is clearly not a motorcycle helmet such as a football helmet. Even then they have to call and get supervisor approval before they issue the ticket. This policy came about as a settlement in the The Quigley v. CHP Civil Case filed in Santa Cruz
The CHP is the only agency with the statutory authority to set helmet standards and did so by regulation. As such,it is expected that policy of other law enforcement agencies will be aligned with CHP policy. If this ticket was issued by CHP, a call to the supervisor will get it undone as policy was violated by the officer.
If it was issued by another agency a first year law student can get it dismissed.
