Colorado has the same cc limits (under 50) doesn't require a license. What you have to watch out for is that if traffic slows then the moped riders often ride onto the sidewalk and then jump back into traffic when ever they please. Gotta keep your eyes open for them. Not sure that is legal but someone told me that since they are not technically classified as motor vehicles then they are not required to stay on the roads.
