I bought mine on a saturday. The dealership closed at 6pm, had a HOG ride gathering in the parking lot, I signed my papers at 6:30 pm. It was hot, and everyone including myself wanted to leave. I did go to Texas Road House, I had a porterhouse. It was my birthday, wife went and bought me a Ultra Limited on my birthday. BTW, the porterhouse was terrible.
forgot to type my reply... dealer never went over that option with me. I looked at it and wondered, what the hell does that mean? sat down in my rocker, glass of bourbon and read the manual........

Can you start the bike in gear? If not, then you might have a bad clutch switch. AFAIK a bad clutch switch would also stop the EITMS from going Active if the bike was in gear.
Mine only turns on in neutral as well. I figured that there was a setting that in neutral is a lower threshold than in gear for it. My first bike with it enabled. My previous bike could have it enabled but it had to be done by the shop.
14GuineaPig: I can't start mine in gear either. Has to be in neutral.
My new 17sgs activates with the bike in gear, friends who bought his 17 rg before me says his only activates when in neutral

EITMS will turn off the rear cylinder fuel injector when all of the following preset parameters are met:
Throttle position is at idle
Motorcycle speed is under 1.2 mph (2 km/h)
Engine speed is under 1200 RPM
Engine Temperature (ET) sensor input reading is above preset level
Ambient Air Temperature (AAT) sensor reading is above preset level (radio equipped models only)
Doesn't say a thing about being in gear or in neutral, but I know mine would activate sitting at stop lights. And not sure, but I would be just putting in neutral wouldn't deactivate it while sitting there. But it SHOULD definitely come on when in gear.
Deactivation: If ANY of the following occur, the rear cylinder fuel injector resumes operation: • Touring (except FLHR, FLHRC, FLHR CVO, FLHRSE, FLHP and FLHTP) and FLHTCUTG: AAT sensor drops below 75 °F (24 °C). • FLHR, FLHRC, FLHR CVO, FLHRSE, FLHP and FLHTP: ET sensor drops below 275 °F (135 °C) (all configurations).
• ETC is above idle.
• Motorcycle speed exceeds 2 mph (3 km/h).
• Engine speed exceeds 1350 rpm. • The clutch is released with the motorcycle in gear.
On my 14 FLHTK, the EITMS will deactivate as soon as you start releasing the clutch lever when the bike is in gear.

If the EITMS will not activate when the bike is in gear OR the bike will not start when the bike is in gear and the clutch lever is pulled to the grip, then I would have the dealer check the clutch switch in the Left Hand Control Module. JMO
