Regarding your second and totally different question, there are no solid facts. Some believe that the dealer can tell. Yet there is nothing I have ever seen, nor been told by my dealer with who I have an excellent relationship with, that their digital tech (the shop computer) can see anything more then the calibration ID, which is simply a text field in the ECM tune file. Some say field regional service managers have some "super special" computer that can tell that an ECM has been flashed by a non-HD tune. I personally don't believe it. Then there's the theory that HD corp, if something is suspect, will have the ECM sent to them and by some forensic method can tell a non-HD flash was applied.
So yes, if someone strolls into a dealer with a non-HD tune with a "wrong" calibration ID, then their warranty is toast.
The last one is the only one I might believe. However, again, no proof has ever been shown. And honestly, I don't believe for a second whoever at your DEALER had his warranty voided by a "letter". Seems implausible.

I would bet money you simply misunderstood what you were told. The EPA issue is called the consent decree - google it. In a nutshell, it means HD can (and likely will) void your power train warranty if you use a tuner OTHER then the EPA approved HD Street Performance Tuner. And in a somewhat more grey area, if you install any other non-EPA approved performance mods (removing catalytic converters, etc.)
Im not going to go into the whole history as to why, so just read the letter of the agreement and youll see.
So either you misunderstood, or if not, I would find a new dealer as your first experience with this one would be getting false information...
Yes, I replaced their stock header with a good one from fuel Moto. Replaced the stock slip-ons with great sounding and performing S&S MK45s, replaced the stock cam with a Wood MW8-22X. Tuned everything with DynoJet Power Vision and the bike is absolutely fun! What a blast to ride!
