Default starter /bendix/jackshaft not engaging

when i got this bike a year ago the starter was grinding badly until it finally gave up completely. i replaced the starter. It started great for about 20 starts over the winter then began grinding and now the Bendix isn't popping out far enough to engage the flywheel to spin the engine. Im researching but if anyone has delt with this i would appreciate the heads up to save some time. I charged the battery to verify that wasn't the issue. the starter is new with around 20 starts on it, the jackshaft is not new. its the original from 1998. the Bendix teeth do have some damage on them but that's not what's causing this. i tried to add a video and its not working. nothing else is so why should the video? I read that the spring behind the jackshaft can get weak and cause this. when i replaced the started i reused the old spring. anyone had that happen? i removed the spring and its very easy to collapse.

The gap between the pinion and ring gear looks too large. You may have torqued the Bendix bolt too tight and bent the snap ring in the coupling.
