It came new from the dealer back in 06 with the pipes. Therefore, I do not know.
When I pulled them to install the clutch cable, I did not replace the gaskets. I asked several guy to include an HD mechanic if I needed to and they all said, no. but then I have not had the problem since I reinstalled them, it was before.

I have torqued my header bolts 2X since I installed the pipes about 3k mi ago. I think I torqued them at 500mi post install and they did not move much before the wrench clicked. The second iteration yielded little movement and I have no leaks. I will probably not check them again until 10k. Have about 5300 on it now.

It is not leaking anymore, the problem was the nuts themselves were not torqued when I removed the pipes. Just stating, I did not realize I had an exhaust leak and I will check the exhaust flange nuts for now on when I service the bike. However, you are correct if it is an on going issue of them coming loose I will replace the gaskets.

I put new pipes on 07 Sporty, and two 08 Bones in the last 2 weeks and none of them had torqued down flange bolts. I am going to check mine at 100 miles and again at 500 with the new pipes to be sure I dont get any leaks.
