I bought a new 2009 FLSTC August 31, 2009 and have the 5th gear whine. I searched all the HD forums before buying it looking for 2009 FLSTC problems and found none.
Thought they may have forgot to fill the tranny and checked the fluid level. It was overfilled?
The dip stick looks to be chrome plated, but most of the chrome is gone and it is a black color now?
Has anyone seen this? Is the tranny fluid acidic or the engine heat causing this?

Sounds like a defect to me. Mine is 2 years old and chrome is like new. You did check the fluid on the jiffy right? If you put some heavier lube in, something like 75-140 it might quiet the whining down a bit. I use Spectro 6 speed syn in my 08. I have Bel-Ray in the wife's Deluxe.
Have they changed the way you are suppose to check the transmission fluid level, when they went to the 6-speed?
On my 2005 SE, Fat Boy, you check the level with the bike sitting straight up.
The engine oil level you check on the jiffy stand.

I have a 2009 Fatboy, and my manual says to check it cold, on the side stand, and just set the dipstick in on the threads-don't screw it in to check level. Mine was low from the dealer when I got it. Only 4oz. needed from "add" to "full" FYI. Hope this helps.
