Two up with the upswept is not a big deal at all, I don't understand the concern? Do you think the passengers leg hits the exhaust? My wife has ridden before and has never mentioned a concern when riding with me.
Samson makes these pipes for riders and their passengers. They are in the Legend series of pipes. They look great on your bike.

Ok I have another question. I am looking online and dont see many pipes specifically for the 09 xbones. Are all the softails the same mounting even if it doesnt have a 200mm tire?
Im my opinion, the upswept samson fishtails are the only option - check them out on their website. They look good,you can instll easily yourself provided you have the stage 1 upgrade and they give a better, linear power delivery. I replaced my V&H longshots with these babies and never looked back

All Samson Softail exhaust will fit the crossbones from 07-10. it is built on the softail chassis.
