There are no certain years to avoid with either bike. It all depends on what you want. I have 06 Deluxe with a 95" and stock 5 speed. Sometimes I wish I had that 6 speed but not too often. You can get efi with the newer older bikes too (older then 07).
i noticed that some people have commented that a deluxe is for shorter people. I'm about 5' 10". to tall/ I really like the look a deluxe but one of the reasons I'm looking to upgrade is comfort.
Any additionally comments?
I'm 5'11"-ish and I've lowered my Deluxe as far as you can. So it depends on what you want to do in the future.
My previous bike was also a Sportster, and the Deluxe was so easy to ride, due to a lot lower center of gravity. I was so sure I was gonna feel the weight difference, but it's a lot nicer than the Sporty.
Good luck with whatever you choose. Getting a new bike is always a good time!
I also moved up from a Sportster (1200 L) to the Lux, couldn´t be happier. Test rode the Heritage and the Deluxe - the Deluxe suited me much better, as far as seat and handlebar position is concerned. Test rode the 88 cui, bought the 96 cui (07) - there is quite a difference. Go for the bigger engine! In contrast to the Sportster the Lux seems easier to get around corners, you feel as if you sit in, not on the bike. And I think there´s more room for personal mods than there is with the Heritage. And - of course - it has this old-style look ...

im 5'10 love my deluxe and made it mine. i put drag bars, a lapera seat on it and its good to go.
As someone else said you need to look at your riding and all. If you are goin to do some roadtrips, a heritage might be a better thought because it comes with bags and windshiled...
