I have had no issues with not having the brace across the bottom. I have taken multiple trips with the bags loaded down and they never "flex". It does look like them new version from the have the cross bracket. I always figured if they did flex I could fab a bracket but in two plus years I have had no issues. You wont have an issue with the bike being lowered. I have the shot gun on my bike with no issues.Remember only the swing arm is moving. So unless you have something mounted on the swing arm you will be fine. Only thing you need to make sure of is the exhaust needs to be lower than stock. Here is mine with the rear dropped.

First off nice looking bike you have, I don't know this for a fact but I'm pretty sure the ABS hard bags are a little heavier than your leather bags but again I can't be certain so don't hammer me on it if I'm wrong...If they are then I would recommend getting the kit with the brace in the rear just to be safe. Even with my bags mounted wrong I could take them and move them around which was a little scary thinkingthey could fly off at any moment.
No problem. I do think that the hard leather and ABS plastic bags are about the same weight, but I also do not know for sure. All my buddies have speakers in their bags so that makes them much heavier than mine. I am surprised that you can move your bags. Mine do not really move at all. Only thing I changed on mine is I use Bolts instead of the factory fittings to attach the bags to the brackets. I also run with detachable hardware for the passenger backrest so maybe that acts as a larger washer and prevents the pivoting as well. Just kinda thinking out loud on why yours would flex so much. Either way I do not think you can go wrong with any of the brackets out there. They all seem to be vary similar. Also thanks for the props on the bike, it is currently torn down changing the chrome to gloss black for something new with 13 inch gangsters on the way as well. Yours is really nice as well, love how the paint on the bags flow with the bike.
Thanks everyone for the responses and posting pics, really nice rides.
Well I got my CV brackets and my lowers in so I could do a mock up. Did anyone notice that their back fender looked a little off to one side? After installing the mounting brackets. I have always know that there was more of a gap between the right side of the tire than the left. But, after installing them it is more noticeable. Also it's like the left side bag had to be flexed in order to get it to line up. I am dumping some pictures to www.photbucket.com/silverbags
