This is just an improper installation. I have installed our true duals so many times over the years and it can be easily corrected.
What I always do is keep everything loose especially the rear Upipe and crossover pipe and put a level across the mufflers before tightening everything down. Also it would be wise to put a torpedo level on the rear brake disc while the bike is on a lift to make sure it isn't strapped down crooked. This is what I always do to ensure they are level. It's possible the dealer didn't do this and thought they were aligned correctly.
The other part is that both of the muffler brackets have about a 1/8" bit of play that you will also be able to adjust accordingly in order to get them to line up perfectly.
