In that position it looks like the misty air would be filtered and escape but wouldn’t the oil just sit in the tubes now ?

The misty air as it condenses will leave oil in the pipe close to the breather exit.
The only time that there would be a problem routing the hoses up is if there were lots of short rides, especially in cooler weather, with no longer rides sprinkled in the mix.

When the engine is fully heat soaked, the oil and condensation that accumulates in the hose and breather channels will get vaporized and evacuate via the filter or catch-can or open hose.

But if the engine never gets ridden for any distance, fully warmed up, then routing the hoses up will result in them filling up with a combination of oil and condensation. This will not cause any engine damage, this gunk will not go back into the engine oil, but it will eventually fill up the hoses if the engine is never run to full operating temp for a period of time.

Here are photos of a couple of my bikes that have the hose routed up. Both of these bikes see lots of shorter runs in cooler weather, but they also both see longer rides of an hour or more on a regular basis.

It's a recent addition (thanks to DK Custom of course).

I did it that way mostly because it looked good, but I could easily move it below instead if that is "better" for the escaping air/oil/whatever?
Yes, you are good to go with either set up...unless you rarely run the bike at full operating temperature...in that case, route the hose down.
